General

• Users and advertisers are responsible for ensuring that all content, including text, images, graphics, and video ("Content") uploaded to hawa.lk complies with all applicable laws and regulations.
• hawa.lk and Prezire Software Solutions assume no responsibility for the accuracy, legality, ownership, or completeness of any Content uploaded by users.
• Users guarantee that their Content does not violate any copyright, intellectual property rights, or other rights of any individual or organization. Users agree to release hawa.lk and Prezire Software Solutions from all liabilities arising from the use or inability to use the service.
• Service Provider Disclaimer: hawa.lk is a platform and is not involved in the actual sale or purchase of vehicles. The company does not guarantee, validate, authorize, or endorse the condition, ownership, pricing, images, or details displayed by sellers.
• hawa.lk reserves the right to remove any content deemed inappropriate by the site administrators, including but not limited to spam, duplicate listings, suspicious content, non-automobile ads, vehicles not located in Sri Lanka, and Japanese auction advertisements.
• If an advertisement is removed due to the vehicle being outside Sri Lanka, users will be notified once with instructions to reinstate the listing by paying the applicable fee. Repeated violations may result in immediate removal without notice.
• hawa.lk may request additional documentation to verify the authenticity of any advertisement. Failure to comply may result in removal of the listing.
• Prezire Software Solutions reserves the right to edit or modify advertisements for editorial or formatting purposes at its sole discretion.

Fees & Paid Services

• Posting Fee for Brand New or Unregistered Vehicles: A fee of Rs. 650 applies to all advertisements for brand new or unregistered vehicles at the time of posting. This applies to both individual users and vehicle dealers. Unpaid listings may be removed without notice. The fee is applicable per posting and will not be refunded under any circumstances.
• Users who advertise using a leasing price as the primary displayed price will be issued a warning. Repeated violations may result in the user's phone number being blocked from the system. A fee of Rs. 5000 will be charged to unblock the number.
• Duplicate Ad Posting: Users are prohibited from posting the same advertisement multiple times within a single day. Repetitive postings may result in removal or account restrictions. To increase visibility, users may use the Bump Up feature instead.

Copyright

• Advertisers grant hawa.lk a perpetual, royalty-free, irrevocable, non-exclusive right to use, modify, publish, distribute, translate, and create derivative works from submitted Content in any format or medium.
• All content, trademarks, brand names, software, and intellectual property on hawa.lk are owned by Prezire Software Solutions or its licensors. No material may be copied, reproduced, republished, stored, posted, or distributed without written permission.

Watermarks

All images on hawa.lk are watermarked to discourage unauthorized use. Removing, altering, or reusing images without permission is prohibited.

Feature Availability

Certain website features may not be available on the mobile applications. The company may modify, add, or remove features in mobile versions without notice. Users acknowledge that functionality may differ across platforms.

Email Addresses & Phone Numbers

Users must provide a valid email address and phone number. Accounts with invalid or unverifiable details may be removed without prior notice.

Donations / Contributions

All donations or contributions made by users are strictly voluntary and non-refundable.

Verification of Number Plates

Users may request a Number Plate Verification Badge by submitting a clear image of the vehicle showing the plate and the vehicle registration book. Prezire Software Solutions reserves the right to approve or decline verification requests.

Number Plate Verified Badge

The verification badge only confirms that the number plate matches the registration document provided. It does not guarantee ownership, condition, service history, or authenticity of other documents or images provided.

Disclaimer

hawa.lk and Prezire Software Solutions assume no liability for: (a) errors on the website or Content, (b) third-party links or content accessed through the platform, (c) service interruptions or downtime, (d) actions of users, or (e) equipment or software used in connection with accessing the site.

Indemnification

Users agree to indemnify hawa.lk, its officers, employees, and agents from all losses, damages, legal fees, and claims resulting from violation of these Terms and Conditions or misuse of the platform.

Modifications

Prezire Software Solutions reserves the right to modify these Terms and Conditions at any time. Changes become effective immediately upon publication. Continued use of the service constitutes acceptance of updated terms.

Governing Law

These Terms and Conditions are governed by the laws of Sri Lanka. All disputes shall be subject to the exclusive jurisdiction of the Courts of Sri Lanka.

Termination

If users disagree with any part of these Terms and Conditions or are dissatisfied with the service, their sole remedy is to discontinue use of the platform.
